Citizens in all federal states have the opportunity to start a referendum and thus a referendum at municipal or district level. This enables them to intervene in local politics and actively shape it. At the federal level one speaks of a referendum or referendum.

The last referendum or referendum in Burghausen took place in 2015. Here the citizens decided on the preservation of the district hospital in Burghausen. The referendum came out with a clear result in favor of maintaining the clinic.

Who can participate?

People who are also entitled to vote in local elections and who have had their main place of residence in Burghausen for at least two months may sign petitions and vote in referendums in the city of Burghausen.

Process

The Bavarian municipal constitution or the municipal ordinance regulates citizens' petitions and referendums.

First, the citizen's request must be submitted to the municipality. The question of the request must be formulated in such a way that it can be answered with yes or no. Adequate justification must also be included. In addition, up to three persons who are authorized to represent the signatories must be named.

If enough people have signed the citizens' petition within this period of time, it will be presented to the city council. The request will first be checked for admissibility. If the request is admissible, there are two options: The city council accepts the concern of the citizens' request and takes care of it. The city council does not accept the concern of the citizens' petition, then a citizens' decision is carried out.

The referendum must then be carried out on a Sunday, usually no later than three months after the admissibility of the referendum has been determined.

If a referendum is successful in Burghausen, the city administration must implement the decision. In addition, the decision is binding for one year. Only then can the city council act against the referendum again.
